1. Introduction

1.1 Participation in this Promotion and information regarding redemption of any Gift forms part of these terms and conditions.

1.2 By participating in this promotion, participants (“Participants”) warrant that they have read, understand and agree to be bound by these terms and conditions.
1.3 Participants must be over the age of 18 years. Photographic proof of age identification may be required to be produced upon Gift redemption.

2. Privacy Collection Notice

2.1 This Notice explains how the Promoter and its affiliates (“We/Our”), manage your personal information and complaints. More information can be found on Our Privacy Policy at www.merivale.com/privacypolicy

2.2 We collect Participants’ personal information directly from Participants wherever practicable. We may collect personal information from our related companies or other third parties.

2.3 We will use your personal information primarily to conduct the Promotion, confirm and maintain your booking, and provide information about the products and services you have requested offered by us. We will also use this information for research to improve our products and services. If you do not provide us with that information, we may be unable to process your Booking.

2.4 We may disclose your personal information, including updates, to the promotion partners, including American Express and Moet Hennessy Australia, agents or contractors acting on our behalf and regulatory authorities where required by law.

2.5 Our Privacy Policy sets out how you can access and make a request to correct your personal information we may hold about you, or to make a privacy complaint, and how we will deal with the complaint. 2.6 By entering into the Promotion and/or providing the Promoter with their contact details, a Participant thereby consents, without the requirement for any further act or omission, to the Promoter contacting them for marketing purposes. The Promoter’s use of any or all of a Participant’s personal information will be in accordance with the Privacy Policy, available here https://merivale.com.au/privacypolicy.

3. Duration

3.1 This Promotion Period runs from Wednesday, 1 August 2018 and ends at the end of service on Friday, 31 August 2018 inclusive or when the 3,500 available Gifts have been exhausted.

4. Eligibility

4.1 This Promotion is only open for restaurant bookings made and redeemed within the Promotional Period OR until 3,500 Bookings have been allocated to Participants.

4.2 Participants must be over the age of 18 years and above to provide photographic proof of age identification upon request.
5. How to Participate/Redeem Gift

5.1 To qualify for and participate in the Promotion, Participants must during the Promotional Period:

(a) Participants must be the primary Card holder of an American Express Card, and must validate and secure their Booking with their valid American Express Card (“Card”) to qualify. If a Card is not registered at the time of Booking, this Promotion does not apply.
(b) Participants must make a lunch or dinner restaurant booking for a date within the Promotion Period (“Booking”) at a Participating Venue at either www.merivale.com or by calling the relevant Participating Venue by telephone. Bookings are essential.
(c) Bookings must be for a minimum of four guests dining with at least a A$200 total food and beverage dining spend for the Booking. The total food and beverage spend excludes the cost of the Gift.
(d) The Participants must book with their American Express Card and the full bill must be charged to the Card used to secure the Booking.
(e) One Gift only is available per Booking.
(f) One bill per Booking and no split bills are available.
(g) Normal Merivale cancellation terms and conditions apply as detailed at www.merivale.com, within the resultant Booking confirmation email or as disclosed by a Merivale Restaurant Reservations representative at the time of Booking.
(h) The Gift must be consumed in venue, within the Booking and cannot be removed from the Participating Venue.
(i) If the Gift is not available at the time of redeeming the Gift, then a replacement champagne of equal or higher value to the Gift will be offered.
(j) No part of the Gift can be redeemed for cash nor does it hold any cash value.
(k) Participating Venues only includes the Merivale venues in Item 3 of the Schedule to these Terms and Conditions.
(l) The Promotion is not available with any other Merivale discount or Merivale promotional offer.

6. General

6.1 Any cost associated with entering the Promotion by a Participant, is and will be that Participant’s responsibility.

6.2 The Promoter (including each of their officers, employees and agents) will not be liable for any loss, damage or personal injury (including liability in negligence) or any loss of opportunity whether direct, indirect, special or consequential arising in any way out of a Participant’s participation in the Promotion except for any liability which cannot be excluded by law.

6.3 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any similar consumer protection laws in the State and Territories of Australia.

6.4 Each Participant, by and upon redeeming this offer, acknowledges that:

(a) this Promotion is subject to the laws of the State of New South Wales to the exclusion of any other law; and
(b) any dispute arising under these Conditions of Entry or otherwise in respect of this Promotion, will be submitted to and determined by to the exclusive jurisdiction of the courts of New South Wales.

6.5 The Promoter encourages consumers to consume alcohol in moderation. Legal aged consumers are advised to consider the ‘low risk drinking’ guidelines recommended in the National Health & Medical Research Council Australian Alcohol Guidelines which states: for healthy men and women, drinking no more than two (2) standard drinks on any day reduces your risk of harm from alcohol-related disease or injury over a lifetime. Drinking no more than four (4) standard drinks on a single occasion reduces the risk of alcohol-related injury arising from that occasion. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol.
